Rules for using gift certificates of Lviv Candle Manufactory

1. Basic concepts

1.1. A Gift Certificate is a paper/electronic card of a certain denomination and a certain period of validity together with a tab with the "Rules for using the Gift Certificate", which entitles the Buyer/Holder to purchase goods in the Seller's store or in the Seller's online store from the assortment available on the date of purchase, except for another Gift Certificate, and at the price valid at the time of purchase, for the amount corresponding to the face value of the Gift Certificate.

1.2. The Seller (Owner) is the sole proprietor of the FOP Sidor A.P., who is the owner of the Gift Certificate.

1.3. The Buyer is the person who purchased the Gift Certificate from the Seller. The Buyer has the right to transfer the Gift Certificate to third parties. When transferring the Gift Certificate to third parties, the Buyer is obliged to notify such third party of the validity of the Gift Certificate and the terms of these "Rules for using the Gift Certificate". The Seller does not verify the legitimacy of the receipt of goods under the Gift Certificate by third parties.

1.4. The holder of the Gift Certificate is any person who presents the Gift Certificate for the purchase of goods.

1.5. The Seller's store is a trade facility operating under the Lviv Candle Manufactory trademark.

1.6. The purchase of a Gift Certificate is considered a prepayment for the purchase of the Goods, which will be transferred to the bearer of the Gift Certificate in the future, from the assortment available in the Seller's store on the date of purchase of the Goods and at the price valid at the time of purchase of the Goods, in the amount corresponding to the face value of the Gift Certificate.

1.7. The "Gift Certificate" is not a payment document, means of payment or security.

2. Types of "Gift certificates"

2.1 The "Gift Certificate" has fixed denominations: UAH 300, UAH 500, UAH 1000. The nominal value of the "Gift Certificate" is indicated in UAH and is equal to its value.

3. The procedure for purchasing a "Gift Certificate"

3.1 The "Gift Certificate" can be purchased for cash or using a bank payment card through the cash desk of the Seller's store or by placing an order through the Seller's online store (candles.lviv.ua) by making a non-cash payment to the Seller's bank account for the "Gift Certificate". When purchasing a "Gift Certificate", the Buyer is also issued a cash (fiscal) check or other payment document for the amount of money paid.

3.2. When purchasing a "Gift Certificate", the Buyer pays a sum of money equal to the fixed face value of the "Gift Certificate" and is a prepayment for the goods to be purchased by the "Gift Certificate" Holder in the future.

3.3 The "Gift Certificate" automatically becomes active immediately upon its purchase (in case of purchase through the Seller's store cash desk) and within 24 hours from the moment of receipt of the "Gift Certificate" (in case of purchase by bank transfer).

3.4. When purchasing a "Gift Certificate", the loyalty programme of the "Gift Certificate" Seller is not valid.

3.5. When purchasing goods using the "Gift Certificate", the loyalty programme of the "Gift Certificate" Seller is valid. If the Holder is not a member of the above programme, then when purchasing goods using the "Gift Certificate", he/she may, if desired, become a member of such programmes. 4.Purchase of goods (services) using the "Gift Certificate"

4.1 The "Gift Certificate" can be used only once during one trade transaction (purchase with one receipt) or when placing one order through the Seller's online store (candles.lviv.ua).

4.2. In case of purchasing goods using the "Gift Certificate" in the Seller's store, the Holder must present the "Gift Certificate" to the cashier exclusively at the cash desk of the Seller's store when purchasing the Goods that the Holder wishes to receive. In case of purchase of goods using the "Gift Certificate" through the Seller's online store (candles.lviv.ua), the Holder of the "Gift Certificate" shall enter the certificate number in the appropriate field when placing the order. The goods are delivered to the Holder in accordance with the selected delivery method.

4.3. When purchasing goods using the "Gift Certificate", the "Gift Certificate" shall be withdrawn by the cashier when purchasing in the store by the Holder or in case of purchasing the Goods through the Seller's online store, sold in accordance with the procedure provided for in clause 4.2. of these Rules and deactivated (invalidated).

4.4. If the purchase amount exceeds the nominal value of the "Gift Certificate", the Holder is obliged to pay the difference between the price of the goods and the nominal value of the "Gift Certificate".

4.5. If the purchase amount is less than the nominal value of the "Gift Certificate", the difference between the price of the goods and the nominal value of the "Gift Certificate" is not compensated to the Holder, is not transferred to subsequent purchases, and is not subject to payment in any form. After the Holder makes a purchase of goods using the "Gift Certificate" for an amount that is less than the nominal value of the "Gift Certificate", the obligations of the "Gift Certificate" Seller are considered terminated.

4.6. The obligations of the Seller of the "Gift Certificate" are limited by the validity period of the "Gift Certificate", the product range available in the Seller's store, the face value of the "Gift Certificate", the opening hours of the Seller's store, as well as other terms of these Rules for the use of the "Gift Certificate".

5. Validity of the "Gift Certificate"

5.1. The validity period of the "Gift Certificate" is limited and is 12 calendar months from the date of its purchase. The moment of purchase and receipt of the "Gift Certificate" is the moment of issuance to the Buyer of a cash (fiscal) receipt or other payment document confirming the purchase of the "Gift Certificate".

5.2. If the Buyer/Holder of the Gift Certificate does not exercise the right to purchase the goods during the validity period of the Gift Certificate, the obligations of the Gift Certificate Seller are considered terminated, and the amount of money paid for the Gift Certificate is non-refundable and remains at the disposal of the Seller.

5.3. The holder of the Gift Certificate loses the right to use it from 00:00 hours of the date following the last day of the Gift Certificate validity period.

5.4. The validity period of the "Gift Certificate" cannot be changed, extended or renewed.

6. Return of the "Gift Certificate" and cancellation of the contract of sale of goods

6.1. The "Gift Certificate" is non-refundable and cannot be converted into a cash equivalent.

6.2. The contract of retail sale of goods purchased with the use of a Gift Certificate may be terminated on the grounds and in the manner prescribed by the current legislation of Ukraine, in the Seller's store where it was concluded or in accordance with the rules of use of the Seller's online store (candles.lviv.ua). In case of termination of the contract of retail sale of goods, the funds are returned in accordance with the procedure provided for by the current legislation of Ukraine.

6.3. Elimination of defects and/or significant defects of the goods purchased using the "Gift Certificate" shall be carried out on the grounds and in the manner prescribed by the current legislation of Ukraine.

7. 7.

7.1. The owner of the "Gift Certificate" reserves the right to make changes and additions to these Rules for the use of the "Gift Certificate".

7.2. Any changes and amendments to these Rules shall not be subject to prior approval by the Buyer/Holder.

7.3. The Seller of the "Gift Certificate" informs about amendments and additions to these Rules for the use of the "Gift Certificate" by publishing them on the website candles.lviv.ua.

7.4. These Rules for the use of the "Gift Certificate" are a contract of adhesion in accordance with the requirements of Article 634 of the Civil Code of Ukraine. The conclusion of such an agreement is possible only by accession of one party to the proposed agreement. By purchasing the "Gift Certificate", purchasing goods using the "Gift Certificate", the Buyer / Holder certifies that he/she has read these Rules and confirms his/her agreement with these Rules for using the "Gift Certificate".

7.5. The Seller of the "Gift Certificate" shall be released from the obligation to provide the goods under the lost (damaged) "Gift Certificate", or from the obligation to return the funds paid by the Buyer upon purchase of such (lost/damaged) "Gift Certificate" and, accordingly, shall be released from liability for refusal to provide the goods or return the funds in case of loss (damage) of the "Gift Certificate".

7.6. The Seller of the "Gift Certificate" is exempt from liability for the consequences of the loss or transfer of the "Gift Certificate" by the Buyer to a third party, and in case of misuse of the Gift Certificate by third parties.

7.7. The Seller shall not be liable to the Buyer for the sale of goods to third parties on the basis of the "Gift Certificate" purchased by the Buyer, provided that the Seller complies with these Rules for the use of the "Gift Certificate".

7.8. A lost (damaged) "Gift Certificate" cannot be renewed.

7.9. The seller of the "Gift Certificate" has the right not to accept the "Gift Certificate" in case of doubt as to its originality and/or damage.

7.10. The risk of accidental loss, damage or loss of the "Gift Certificate" is borne by the Buyer / Holder from the moment of purchase of the "Gift Certificate".
